By using Pianist Express™, you agree to be bound by these Terms of Use, including any future updates or modifications. If you do not agree to these Terms of Use, you must immediately stop using the platform.

Description of Services

Pianist Express™ provides a platform for users to browse and search for a variety of services and events related to the music industry, including but not limited to: Teachers/Schools, Piano Movers, Piano Tuners, Collaborative Pianists, Recording Services, Photographers, Competitions, Concerts, Festivals, Concert Hall Rentals, and Practice Room Rentals. Pianist Express™ also provides a marketplace for users to buy and sell pianos, sheet music, and accessories.

Account Creation and Eligibility

To use the services provided by Pianist Express™, you must create an account and become a member. You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. By creating an account, you agree to provide accurate and complete information, and to update your information as needed to keep it accurate and complete. Providing false information is strictly prohibited and may result in termination of your account and legal consequences. You are solely responsible for maintaining the confidentiality of your account information and password, and you agree to accept responsibility for all activities that occur under your account.

In addition, creating a Pianist Express™ Account also constitutes creating an account with Piano League. By creating a Pianist Express™ account, you are agreeing to the terms of use and privacy policy of both Pianist Express™ and Piano League.

Listing and User Content

Pianist Express™ allows members to create listings for services and events and to submit reviews and ratings of services and events. By creating a listing, you grant Pianist Express™ a non-exclusive, worldwide, royalty-free, transferable, sub-licensable, right and license to use, copy, modify, distribute, publicly display, and otherwise exploit your listing in all media formats and distribution channels. You represent and warrant that your listing and any information you submit will be accurate, not misleading, and not in violation of any applicable laws or regulations.

When creating a listing or submitting content, please make sure to abide by the following guidelines:

• Your listing or content should not be illegal, obscene, defamatory, threatening, infringing of intellectual property rights, invasive of privacy or otherwise injurious to third parties.
• Your listing or content should not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.”

Pianist Express™ reserves the right, in its sole discretion, to remove any listing or user content that it determines to be in violation of these guidelines or otherwise inappropriate.

Fees and Services

Pianist Express™ does not charge members to create an account or to browse the platform. However, Pianist Express™ charges fees for certain services, including but not limited to: listing and promoting events and services, and for using the marketplace to buy or sell items. These fees are described on the platform and are subject to change at any time. By using a paid service, you agree to pay the applicable fee.

Termination

Pianist Express™ may terminate your account and your use of the platform at any time, for any reason, and without notice. You may terminate your account at any time by contacting Pianist Express™ and requesting that your account be deleted.

Disclaimers and Limitation of Liability

Pianist Express™ provides the services on an “as is” and “as available” basis. Pianist Express™ makes no representations or warranties of any kind, express or implied, as to the operation of the services or the information, content, materials, or products included on the services. Pianist Express™ does not warrant that the services will be uninterrupted or error-free.

You expressly agree that use of the services is at your sole risk. Pianist Express™ shall not be liable for any damages of any kind arising from the use of the services, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.

Pianist Express™ is not responsible for the actions or inactions of any third party, including members, service providers, or other users of the services. Pianist Express™ makes no representations or warranties as to the accuracy, completeness, or truthfulness of any content submitted by third parties, including listings and reviews. You understand that by using the services, you may be exposed to content that is offensive, harmful, inaccurate, or otherwise inappropriate. You agree to use the services at your own risk.

Indemnification

You agree to indemnify, defend, and hold harmless Pianist Express™, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your account.

Governing Law and Jurisdiction

These terms and conditions are governed by and construed in accordance with the laws of the state in which Pianist Express™ operates and you hereby consent to the exclusive jurisdiction of the courts in that state or location.

Changes to Terms

Pianist Express™ reserves the right to make changes to the terms and conditions at any time. Any changes made to the terms and conditions will be posted on the site and will become effective immediately upon posting. Your use of the site following any such changes constitutes your agreement to follow and be bound by the terms and conditions as changed. If you do not agree to the changes, you must discontinue using the site.

Assignment

You may not assign your rights and obligations under these terms and conditions to any party, and any purported attempt to do so will be null and void. Pianist Express™ may assign its rights and obligations under these terms and conditions without condition.
